1. Acceptance of Terms

By accessing, registering with, or using any services provided by phkuya (hereinafter referred to as "the Platform", "we", "us", or "our"), you (hereinafter referred to as "the User", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (hereinafter referred to as "Terms") in their entirety. These Terms constitute a legally binding agreement between you and phkuya governing your use of our online casino, sports betting, and gaming services accessible through the website phkuya.cam and any associated mobile applications or platforms.

If you do not agree with any provision contained within these Terms, you must immediately discontinue use of the Platform and refrain from creating an account or engaging with any phkuya services. Your continued use of the Platform following any amendments or updates to these Terms constitutes acceptance of such modifications. We reserve the right to modify, amend, or update these Terms at any time without prior notice, and it is your responsibility to review these Terms periodically to remain informed of any changes. By registering an account, you represent and warrant that you have reached the minimum legal gambling age required by the laws and regulations of the Republic of the Philippines and the jurisdiction from which you are accessing the Platform. phkuya operates in compliance with Philippine gaming regulations, including standards established by the Philippine Amusement and Gaming Corporation (PAGCOR), and we reserve the right to request age verification documentation at any time. Provision of false information regarding your age constitutes a material breach of these Terms and will result in immediate account termination and forfeiture of all funds.

2.2 Account Registration Process

To access gaming services on phkuya, you must complete the registration process by providing accurate, current, and complete information including your full legal name, date of birth, residential address, email address, and Philippine mobile telephone number. You agree to maintain and promptly update your account information to ensure accuracy at all times. Each individual person may register and maintain only one (1) account with phkuya. Creation of multiple accounts, whether by the same person or through use of false identities, is strictly prohibited and constitutes grounds for immediate termination of all associated accounts and forfeiture of balances contained therein.

2.3 Geographic and Legal Restrictions

phkuya services are intended exclusively for users located within the territorial boundaries of the Republic of the Philippines. You represent and warrant that you are physically located within Philippine territory at the time of account creation and during all gaming activities. Access to phkuya from jurisdictions where online gambling is prohibited by law is strictly forbidden. You are solely responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction of residence and access.

3. Account Security and Responsibilities

3.1 Username and Password Security

Upon successful registration, you will select a username and password to access your phkuya account. You are solely and exclusively responsible for maintaining the confidentiality and security of your login credentials. You must not share your username, password, or any other account access information with any third party under any circumstances. You agree to immediately notify phkuya of any unauthorized access to your account or any other breach of security. phkuya shall not be liable for any losses, damages, or unauthorized transactions resulting from your failure to maintain the confidentiality of your account credentials or from any unauthorized access resulting from your own negligence.

3.2 Account Verification and Documentation

phkuya reserves the right to request identity verification documents at any time, including but not limited to government-issued identification cards, utility bills, bank statements, or other documents establishing your identity, age, and residential address. You agree to provide such documentation within seventy-two (72) hours of request. Failure to provide requested verification documents within the specified timeframe may result in suspension of account privileges, including temporary or permanent restrictions on withdrawals, deposits, or gaming activities. All verification documents must be clear, legible, and valid.

3.3 Account Suspension and Termination

phkuya reserves the right to suspend or terminate your account at any time, with or without cause, and with or without prior notice, at our sole discretion. Grounds for account suspension or termination include, but are not limited to: breach of these Terms, provision of false or misleading information, fraudulent activity, money laundering, collusion with other players, use of automated gaming software or bots, abusive behavior toward staff or other players, or any conduct we determine to be detrimental to the Platform's integrity or other users' experience. Upon termination, you forfeit all rights to your account and any balance contained therein, except where prohibited by applicable law.

4. Deposits, Withdrawals, and Financial Transactions

4.1 Deposit Methods and Processing

phkuya accepts deposits through various payment methods including GCash, PayMaya, bank transfers, and other methods designated on the Platform from time to time. Minimum and maximum deposit limits apply and are displayed on the Platform at the time of transaction. You agree that all deposits made to your phkuya account are intended solely for the purpose of wagering and gaming activities. All deposits are final and non-refundable except in cases of technical error or as otherwise required by law. You represent and warrant that all funds deposited into your phkuya account are legally obtained and that you are the rightful owner of such funds.

4.2 Withdrawal Policies and Procedures

You may request withdrawal of funds from your phkuya account balance at any time, subject to verification requirements, wagering requirements for bonuses, and minimum withdrawal amounts specified on the Platform. Withdrawal requests are processed within the timeframes specified for each payment method, typically ranging from five (5) to fifteen (15) minutes for GCash and PayMaya e-wallet withdrawals to up to seventy-two (72) hours for bank transfers. phkuya reserves the right to request additional verification documentation before processing withdrawal requests and to refuse withdrawal requests that do not comply with these Terms or applicable anti-money laundering regulations.

4.3 Currency and Transaction Fees

All financial transactions on phkuya are conducted in Philippine Pesos (PHP). phkuya does not charge fees for deposits or withdrawals; however, your payment provider may impose transaction fees, currency conversion fees, or other charges over which phkuya has no control. You are solely responsible for any fees charged by third-party payment providers. phkuya displays account balances and gaming winnings in Philippine Pesos, and all wagering, deposits, and withdrawals are calculated and processed in Philippine Pesos.

4.4 Anti-Money Laundering Compliance

phkuya maintains strict anti-money laundering (AML) policies in compliance with Philippine law and international standards. You agree that phkuya may conduct due diligence investigations into the source of deposited funds and may require you to provide documentation establishing the legitimate origin of funds. Suspicious transaction patterns, including but not limited to frequent deposits and withdrawals without substantial gaming activity, may trigger additional verification requirements or account restrictions. phkuya cooperates fully with law enforcement authorities and regulatory agencies in investigations related to money laundering or other financial crimes.

5. Gaming Rules and Fair Play

5.1 Game Outcomes and Random Number Generation

All games offered on phkuya utilize certified Random Number Generators (RNGs) that have been tested and audited by independent third-party testing laboratories to ensure fair and unpredictable outcomes. Game results are determined randomly and cannot be predicted, manipulated, or controlled by phkuya or any user. The theoretical Return to Player (RTP) percentages displayed for each game represent long-term statistical expectations and do not guarantee any particular outcome in individual gaming sessions. You acknowledge that gambling involves risk and that losses are possible. phkuya does not guarantee winnings and is not responsible for any losses incurred through gaming activities.

5.2 Sports Betting Rules and Settlements

Sports betting wagers are subject to specific rules governing each sport, market, and bet type. Odds displayed at the time of bet placement are the odds applicable to your wager. phkuya reserves the right to adjust odds at any time prior to bet acceptance. Bets are settled based on official results as determined by the relevant sports governing body. In cases of postponed, abandoned, or cancelled events, specific settlement rules apply as outlined in our sports betting rules, which are incorporated into these Terms by reference. phkuya's decisions regarding bet settlements are final and binding.

5.3 Game Malfunctions and Disputes

In the event of a game malfunction, system error, or technical failure, all affected wagers shall be void and the stakes returned to the relevant player accounts. phkuya is not liable for any losses, damages, or lost winnings resulting from technical malfunctions, internet connectivity issues, server failures, or other technical problems beyond our reasonable control. If you believe a game has malfunctioned or that an error has occurred in game results or bet settlement, you must notify phkuya customer support within forty-eight (48) hours of the alleged incident. Disputes reported after this timeframe will not be considered.

6. Bonuses, Promotions, and Rewards

6.1 Bonus Terms and Wagering Requirements

phkuya offers various bonuses, promotions, and rewards to eligible players from time to time. All bonuses are subject to specific terms and conditions including wagering requirements, minimum odds requirements for sports betting bonuses, game restrictions, maximum bet limits, and expiration dates. Wagering requirements specify the number of times you must wager bonus funds or deposit plus bonus funds before converting bonus money into withdrawable cash. Failure to complete wagering requirements within the specified timeframe results in forfeiture of bonus funds and any winnings derived from such funds. 6.2 Bonus Abuse and Fraud

phkuya prohibits bonus abuse, including but not limited to creating multiple accounts to claim multiple bonuses, exploitation of technical glitches or errors for personal gain, collusion with other players to meet wagering requirements, or any strategy designed primarily to convert bonus funds into withdrawable cash with minimal risk. phkuya reserves the right to withhold, forfeit, or revoke bonuses, cancel promotional rewards, and close accounts of users engaged in bonus abuse or fraudulent activity. Bonus funds are intended to enhance entertainment value and cannot be withdrawn until wagering requirements are fully satisfied.

6.3 VIP and Loyalty Programs

phkuya operates a VIP loyalty program offering rewards, benefits, and exclusive privileges to qualified players based on gaming activity, deposit history, and other factors determined by phkuya. VIP status, tier levels, benefits, and rewards are subject to change at phkuya's sole discretion without prior notice. phkuya reserves the right to modify, suspend, or terminate the VIP program at any time. Benefits and rewards earned through the VIP program may be subject to additional terms and conditions specified in program materials.

7. Prohibited Activities and Conduct

The following activities and conduct are strictly prohibited when using phkuya services:

• Use of any automated software, bots, robots, or other technological means to interact with or exploit the Platform or its games;
• Collusion with other players to gain unfair advantages, share information, or manipulate game outcomes;
• Fraudulent activity including use of stolen payment methods, chargeback fraud, or provision of false identification or verification documents;
• Money laundering or any attempt to use phkuya services for illegal financial transactions;
• Harassment, abuse, or threatening behavior directed toward phkuya staff, customer support representatives, or other users;
• Reverse engineering, decompiling, or otherwise attempting to access or modify phkuya software, source code, or proprietary systems;
• Circumventing security measures, account verification procedures, or geographic restrictions;
• Exploitation of errors, bugs, glitches, or vulnerabilities in the Platform for personal gain;
• Use of VPN services, proxy servers, or other methods to disguise your true geographic location;
• Engaging in any activity that phkuya determines, in its sole discretion, to be detrimental to the Platform, other users, or the integrity of gaming services.

Violation of these prohibitions constitutes a material breach of these Terms and will result in account suspension or termination, forfeiture of account balances, and potential referral to law enforcement authorities where appropriate.

8. Intellectual Property Rights

All content, materials, software, graphics, logos, trademarks, service marks, design elements, text, images, and other intellectual property displayed on or embodied in phkuya (collectively, "Content") are the exclusive property of phkuya or its licensors and are protected by Philippine and international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, non-commercial gaming and entertainment purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Content without phkuya's prior written consent. Unauthorized use of phkuya intellectual property is prohibited and may subject you to civil and criminal penalties.

9. Limitation of Liability

To the maximum extent permitted by applicable law, phkuya, its directors, officers, employees, affiliates, partners, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure arising out of or in connection with your use of or inability to use phkuya services, even if phkuya has been advised of the possibility of such damages. In no event shall phkuya's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the total amount of deposits made by you to your phkuya account during the six (6) month period immediately preceding the event giving rise to liability, or One Thousand Philippine Pesos (PHP 1,000), whichever is greater.

phkuya provides the Platform and all services on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted access. phkuya does not warrant that the Platform will be error-free, secure, or free from viruses or other harmful components. You acknowledge that gambling involves financial risk and that you may lose money through gaming activities. phkuya is not responsible for any losses incurred through your gaming activities.

10. Dispute Resolution and Governing Law

10.1 Governing Law and Jurisdiction

These Terms and any disputes arising out of or relating to your use of phkuya services shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. You irrevocably consent to the exclusive jurisdiction of the courts located in Metro Manila, Philippines for resolution of any disputes arising under these Terms. Any legal action or proceeding related to your access to or use of phkuya must be commenced within one (1) year after the claim or cause of action arises.

10.2 Dispute Resolution Process

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of phkuya services, you agree to first contact phkuya customer support to attempt resolution through informal negotiation. If the dispute cannot be resolved through customer support within thirty (30) days, either party may pursue formal dispute resolution. You agree that phkuya's decisions regarding bet settlements, bonus forfeitures, account suspensions, and interpretation of these Terms are final and binding except where prohibited by applicable law.

10.3 Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and any specific game rules or promotional terms incorporated by reference, constitute the entire agreement between you and phkuya regarding your use of the Platform and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

By continuing to use phkuya services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
